Terms and Conditions - Accommodation

    1. General Information & Definitions
      1. These Terms and Conditions (“T&Cs”) apply when You make a booking to reserve Accommodation and other related Services provided by The Great Tythe Barn as a Consumer. They also apply to other members of a Your party or their guests, and their use of the Services.
      1. These T&Cs, together will the Booking Confirmation (“the Agreement”) will form Our contract with You.
      1. When booking the Accommodation and other Services, prior to submitting or agreeing the Booking Form, You are required to read, accept and agree to be bound by these T&Cs. You should ensure that the details are correct, and that You carefully read and understand these T&Cs. If You are unsure about any part of the Agreement, please contact Us before proceeding.
      1. The Great Tythe Barn provide other services, including the hire for the Great Tythe Barn itself as a venue for events. Those services are covered by other “venue hire” terms and conditions that can be supplied upon request from the Great Tythe Barn Office.

        1. We may amend these T&Cs at any time and You should therefore check them each time You make a reservation. The terms and conditions applying to Your reservation will be those in place on the date that You make Your reservation. 

The Great Tythe Barn, We, Us, Ourmeans THE GREAT TYTHE BARN Ltd (registered in England and Wales with company number 04922658). Customer, You, Yourmeans the individual who is a Consumer customer booking the Accommodation and other Services and agrees to pay both for themselves as a paying guest of the Accommodation and also for members of their party and any of their guests;
Accommodationmeans the short-term lodgings booked by You and listed in the Booking Confirmation. The Accommodation is provided by Us to You under a licence to occupy and might include Tythe House, Tythe Lodge (or a room or any part of it) or any of the cottages located at the site at Folly Farm, Long Newton, Tetbury, Gloucestershire, GL8 8XA. Details of each of the properties are found on Our Website or brochure;
“Agreement”means the contract between The Great Tythe Barn and You for the Accommodation and other Services made up of these T&Cs and the Booking Confirmation;
Agreement Date:means the date that the reservation is made, listed on the Booking Confirmation;
Booking Confirmationmeans the document that will be sent to You by Us via email once You have submitted the Booking Form online or made a booking over the telephone. It confirms the details of Your reservation and that We have accepted the booking;
Booking Formmeans the online form that You will complete on Our Website when making or confirming Your reservation, or that will be sent to You via email should you book over the telephone. When submitting the Booking Form, You will need to confirm that You agree to these T&Cs either by checking a box on the booking system, or signing and returning the Booking Form to us;
Businessmeans any business, trade, craft or profession carried on by You or any other person or organisation;
Consumermeans an individual Customer, member of the Customer’s party, or guest of the Accommodation who receives Services for their personal use and for purposes wholly or mainly outside the purposes of any Business;
Reservation Depositmeans the up-front sum that You will be required to pay to reserve the Accommodation for Your Stay;
Occupancymeans the maximum capacity of the particular Accommodation that You have booked, as listed on the Website, brochure and/or booking system;
Rate(s)means the prices payable for the provision of Accommodation and other Services as provided in the Booking Form and confirmed in the Booking Confirmation;
Security Depositmeans a sum that You will be required to pay on the Agreement Date where You book Tythe House. The Security Deposit is held until the end of Your Stay and will be refunded in full unless You cause damage to the Accommodation or Our premises; 
Servicesmeans the provision of the Accommodation and any and all other facilities, services and items which We offer alongside the Accommodation including food, drink and other optional extras. The Services include any additional services relating to Your Stay that are requested subsequent to the signing of the Booking Form;
Staymeans the dates and duration for which You make a reservation for Accommodation as confirmed in the Booking Confirmation;
T&Csmeans the terms and conditions set out in this document; and
Websitemeans Our website, which is owned and operated by Us and located at https://www.gtb.co.uk/.

    • Reservations
      • You can book to make a reservation for Accommodation and related Services via the booking system on Our Website, or over the telephone.Reservations for any Accommodation must be made with at least 1 week’s advanced notice prior to the first date of Your Stay.Some types of Accommodation have minimum stay requirements (i.e. a minimum number of nights that You can book Your Stay for). These requirements will be stated on the Website and/or Booking Form and We do not accept bookings that are of a shorter duration.Should We, in error, accept a reservation that is not made with the advance notice (stipulated in clause 2.2) or is of insufficient duration (stipulated in clause 2.3), We reserve the right to cancel the booking, in which case You will receive a full refund of any sums already paid to Us.You should check that the details of Your reservation are complete and accurate before submitting Your Booking Form. We will not be liable for any delay or non-performance if You provide Us with incorrect information.When You submit the Booking Form online or make a reservation over the telephone, this will be considered an offer by You. We may accept or decline the request at Our discretion. The offer will be accepted and Your reservation confirmed, when We send You a Booking Confirmation. At that point, a legally binding contract will be in place between You and Us.You must be at least 18 years old to make a reservation.Information about the Accommodation and related Services can be found on the Website, the Booking Form / Booking Confirmation, and these T&Cs. This will include as a minimum:
        • the main characteristics of the Accommodation and related Services to be provided to You during Your Stay;who The Great Tythe Barn are and how to contact Us;the Rates payable, including taxes, for the Accommodation and related Services;the arrangements for making payments to Us, including how and when;details about the performance of The Great Tythe Barn’s obligations to You, and when they will take place;how any complaints You might have will be dealt with; andthe duration of Your stay and how and when either party can cancel a booking.

        When You submit Your Booking Form to request a reservation, You must provide Us with Your identification information that will include (but not be limited to) Your name, address, contact telephone number and email address.

        • You will need to provide payment details when You make Your reservation. Further details about payment are found in clause 6 below.

    • Occupancy and your guests
      • The Occupancy limits for each type of Accommodation are listed on the Website brochure and/or booking system.You must not exceed the Occupancy limit for the Accommodation.Your are responsible for the acts and omissions of Your guests and any breach of this Agreement caused by them.Either when booking, or prior to Your Stay, You will be required to provide Us with identification information for any other guests staying at the Accommodation during Your Stay. This is a legal requirement and the information will include (but not be limited to) their name, address, contact telephone number and email address.For the duration of Your Stay, You and Your guests will occupy the Accommodation as licensees.All occupants must be allocated a bed unless they are under the age of 2 years old.Those under 18 years old are not permitted to stay in the Accommodation unless a parent or guardian is also staying in the same Accommodation. Children under the age of 16 must be supervised at all times whilst at the Accommodation and on Great Tythe Barn property.We reserve the right to request valid photographic proof of identity and age. Please ensure that any guests using the Accommodation under Your reservation bring identification. We reserve the right to refuse anyone without identification staying at the Accommodation.

        • The Great Tythe Barn reserves the right to inspect to conduct Occupancy checks at any time during Your Stay and:
          • to request the removal of any number of persons in excess of the Occupancy limit;
          • to request the removal of any persons who are not registered as guests at the Accommodation or are unable to verify their identity; or

            • where the above requests are refused, cancel the Agreement for the Accommodation and related Services and demand that You and any other guests immediately vacate the Accommodation.

    • No refunds will be given in such circumstances.

    • Cancelling your reservation

        • If We cancel under clauses 5.4.1 or 5.4.2, We will keep any sums already paid or owed by You to Us. If We cancel under clause 5.4.4 (and the breach occurred prior to booking) or 5.4.4, We will refund You any sums already paid to Us.

    • Check-in and check-out
      • The earliest check-in time on the first day of Your Stay at the Accommodation is as follows:
        • for Tythe House, 16:00hrs; and
        • for all other Accommodation (Tythe Lodge or the cottages), 15:00hrs.
      • We may, at our absolute discretion, agree to earlier check-in or later check-out. This must be agreed by Us prior to Your arrival for Your Stay. Any request should be made in writing or over the telephone using the contact details provided in these T&Cs. An additional fee will be payable by You should we agree.
      • If You do not vacate the Accommodation and check out by the times stated in clause 7.2, or as agreed under clause 7.3 We will be entitled to charge You for an additional night’s Accommodation at the applicable Rate.

        • Instructions for check-in, check-out and collection of keys will be provided to You via email in advance of Your Stay.

    • Food, drink and Catering
      • Unless We specifically state otherwise on the Booking Form and Booking Confirmation (as an additional Service), food and drink are not included with Accommodation.Where food or drink are provided as an additional Service, We will make additional charges for them in accordance with clause 6.3.If You or any of Your party or guests have any special dietary requirements, You should inform Us of them in advance of Your arrival.  We will use reasonable endeavours to accommodate those requirements and, where this is not possible, tell You that We are unable to do so.We will inform You of the timings that apply to the provision of food in advance of, or during, Your stay. No refunds will be given if You do not make use of food and drink or are not available at the appropriate times for meals.

        • Some Accommodation may include kitchen facilities for the preparation, cooking and consumption of food. You must comply at all times with any instructions provided to You for the use of those facilities, whether contained in these T&Cs or within the Accommodation.

    • ACCOMMODATION RULES

    • Access to the Accommodation and parking
      • You and Your guests will only have access to certain parts of the property at which the Accommodation is located. You must comply with any related signage at the property or instructions provided to You.  
      • Limited parking facilities are available for guests. We cannot guarantee that any car parking space(s) will be available for You.  Any vehicle or valuables are left at the vehicle owner’s own risk. You must comply with any related signage at the property.

        • Neither You, or Your guests are permitted to use camper vans or similar overnight, whether in the car park or anywhere at the property.

    • Security and Personal property
      • You are responsible for ensuring the security of the Accommodation during Your Stay. The Accommodation should be kept locked and secured at all times.
      • We accept no liability for the safety or security of Your belongings, or those of other members of Your party or guests.

        • Should loss or damage to Our property or those of Your Party or You or their guests result from Your failure to secure the Accommodation, You may be liable for any losses in accordance with clause 10.

    • Good order, nuisance, anti-social behaviour and health and safety
        • The Great Tythe Barn have a responsibility to You, Your guests, other guests at the property, Our neighbours, staff and ourselves to ensure that the environment at Our premises is friendly and damage to wildlife and the environment is kept to a minimum. The Great Tythe Barn also have to ensure that We comply with licensing, health, safety and environmental health regulations and other legal requirements. The following will therefore apply to Your Stay:
          • smoking is prohibited in the Accommodation. If anyone in Your party is found to be smoking in the Accommodation they, or You, will be subject to an additional cleaning charge of £150;
          • naked flames (candles etc.) are prohibited in the Accommodation;
          • We operate a zero-tolerance policy to illegal drugs and any other unlawful activity. Anyone found in possession or under the influence of illegal drugs or engaging in or threatening any other unlawful activity will be ejected from the Accommodation and the premises and the police may be called. This includes anyone that We consider to pose a threat to the safety of any other guest, Our staff or the general public. No refunds will be given;
          • You must comply with the reasonable instructions of any of Our staff. You must not be threatening or abusive to any of Our Staff during or after Your Stay;
          • You and Your guests are required to behave responsibly, under a reasonable level of control and in accordance with Our reasonable instructions. This includes (but is not limited to):
            • noise levels, which must be kept to a reasonable level at all times and must not be audible outside the Accommodation after 01:00hrs;
            • general behaviour and sobriety;
            • parking and access; and
            • health and safety of any guest or Our staff.
          • fireworks are not permitted;
          • You must not bring any potentially dangerous or hazardous materials or equipment into the Accommodation or onto Our property;
          • You may not, at any time, allow pets or other live animals in the Accommodation without The Great Tythe Barn’s express written permission. Such permission, and the terms under which they will be permitted, must be sought and agreed no later than fourteen (14) days before the start date of Your Stay. An additional cleaning charge of £150 may be charged if We agree to allow pets in the Accommodation. This prohibition does not include guide dogs for the blind, which are permitted at all times and the cleaning charge will not apply; and

            • all fire exits and access to those fire exits must remain completely unobstructed.  All signs for fire exits and equipment must remain as prominent and visible as they are when the Accommodation is unoccupied.  Fire alarms must not be tampered with. Fire equipment must not be moved from its present location unless being used for its intended purpose.

    • Damage to the accommodation or premises
      • You must not remove, damage or destroy any property belonging to Great Tythe Barn. This includes, but is not limited to:
        • not damaging or removing any fixtures, fittings, furniture, or décor;
        • ensuring that the Accommodation is left in a reasonably clean and tidy condition;
        • where kitchen facilities are provided, using these in a responsible manner and leaving them in a reasonable state of cleanliness;
        • not affixing anything to any part of the Accommodation, particularly using glue or other adhesive, nails, tacks, screws or similar;
        • not using any noxious, corrosive, toxic, explosive or hazardous substance; and
        • avoiding the use of electrical appliances that might overload electrical systems, cause a health and safety hazard or create a fire risk.

        • If You, other members of Your Group, or guests, cause damage or loss of any kind to the Accommodation, the premises, or the property of other guests or their property You will be responsible for that damage and loss, and:
          • You will pay Great Tythe Ban on demand the amount required to make good or remedy any damage including specifically:
            • a fee of at least £150 for the cleaning or replacement of any soiled mattress;
            • a fee of £150 where any part of the Accommodation requires excessive cleaning (including ovens and other cooking facilities); and
            • a fee of at least £150 for any required carpet, upholstery or furniture cleaning,
          • where a Security Deposit has been paid, the costs of remedying any damage will be taken from that Security Deposit. Where the cost of the damage exceeds the Security Deposit, You will be responsible for any additional costs on demand. Where the cost of any damage is less that the Security Deposit, the balance of any Security Deposit will be returned to You; and

            • We may, at our discretion, in addition to charging You for any damage:
              • cancel Your reservation with immediate effect and eject You, members of Your party or guests from the premises;
              • restrict access to the Accommodation and/or the premises;
              • remove Your items from the Accommodation, in which case We will hold Your property for collection by You for no longer than ten (10) days from the end of Your Stay, following which We will dispose of them as We see fit;
              • retain all Charges Paid under the booking. Any request for a refund will be refused; and

                • refuse future bookings from You and/or members of Your party.

    1. Your legal rights and problems with the Accommodation & RElated Services
      1. If there is a problem with any aspect of the Accommodation or related Services at any time, You should inform Us as soon as is reasonably practical as follows:
        1. where possible, prior to or during Your Stay, by raising it with a member of Our staff; or 
        1. at any time, including after Your Stay, by contacting Us using the contact information in these T&Cs or on Our Website.
      1. The Great Tythe Barn always aim to ensure that Your experience is a positive one, and trouble free. We want You to enjoy Your Stay with Us, therefore, in providing the Accommodation and related Services We will:
        1. exercise reasonable skill and care;
        1. provide the Services in accordance with the information provided by Us to You; and
        1. use reasonable efforts to fix any and all faults and problems to the extent that, and as quickly as, is reasonably possible and practical as follows:
          1. where You raise a problem with any aspect of the Accommodation or Services that is Our fault (including Our staff), at no extra cost to You; and
          1. where the problem is caused by actions or omissions that are attributable to You, members of Your Party or Your or their guests, We may charge You a reasonable fee for doing so.

        1. Nothing in these T&Cs is intended to, and will not, affect any rights You have by law as a Consumer, including:
          1. that We carry out Our obligations with reasonable skill and care and in accordance with the information We provide; and

            1. that if We provide You with goods as part of the Services that they are of satisfactory quality, fit for purpose, as described, in compliance with samples shown, and in compliance with any pre-contract information We have provided.

    1. Full details of the Your legal rights, and guidance on exercising them, can be found by contacting Your local Citizens Advice Bureau or Trading Standards Office.

    1. Our liability to You
      1. The Great Tythe Barn will be responsible for foreseeable loss or damage that You may suffer as a result of Our breach of the Agreement or as a result of Our negligence (including Our staff). Loss or damage is foreseeable if it is an obvious consequence of Our breach or negligence or it is contemplated by You or Us when Our contract with You is created.
      1. We are not responsible for any losses that are not foreseeable, or not Our fault, including but not limited to losses that are:
        1. unexpected – i.e. it was not obvious that it would happen, and nothing You said to Us before We accepted Your order meant We should have expected it;
        1. caused by an event outside Our control (please see clause 13) or could not have been foreseen even if We had taken all reasonable care; or
        1. avoidable – something that:
          1. was caused by You, a member of Your Party, Your or their guests, or other third-parties not connected with The Great Tythe Barn;
          1. happened because You did not follow clear instructions or directions given by Us; or
          1. could have been avoided by You taking reasonable action.
      1. The Great Tythe Barn is providing the Accommodation for private (i.e. non-commercial) purposes only.  We make no warranty or representation that the Accommodation will be fit for commercial, Business or industrial purposes of any kind.  You confirm that You do not have such purposes in mind and will not be using the Accommodation in such a manner.  We will not be liable to You for any loss of profit, loss of business, interruption to Business, or for any loss of Business opportunity.
      1. Nothing in these T&Cs seeks to limit or exclude Our Liability for:
        1. death or personal injury caused by Our negligence;
        1. fraud;
        1. any consumer rights that You might have; or
        1. anything else that cannot be excluded by law.

        1. You can find out more about Your consumer rights by contacting Your local Citizens Advice Bureau or Trading Standards office.

    1. Issues outside our control
      1. We will not be liable to You for any failure or delay in performing Our obligations under these T&Cs if the failure or delay is outside Our reasonable control. Examples include, but are not limited to, power failure, internet service provider failure, strikes, lock-outs or other industrial action by third parties, riots and other civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism (threatened or actual), acts of war (declared, undeclared, threatened, actual or preparations for war), epidemic or other natural disaster, or similar.

        1. If an issue described under this clause 13 occurs that is likely to affect any of Our obligations under this Agreement:
          1. We will inform You as soon as is reasonably possible;
          1. Our obligations under this Agreement will be suspended and any time limits that it is bound by will be extended accordingly (where such extension is reasonably possible);
          1. We will inform You when the issue is over and provide details of any new dates, times or availability as necessary;
          1. if You wish to cancel this Agreement as a result, You may do so in accordance with Your right to cancel under clause 5; and

            1. if the issue is likely to prevent The Great Tythe Barn from making the Accommodation available and providing the Accommodation in time for the start date of Your Stay, this Agreement will be cancelled in accordance with Our right to do so under Clause 5 and You will be informed of the cancellation.  Any refunds due to You as a result of that cancellation will be made as soon as is reasonably possible and in any event within 14 calendar days of Our cancellation notice.

    1. How we use your personal data
        1. We use Your Personal Data as set out in Our Privacy Notice.

    1. Feedback, Complaints and Feedback
      1. We welcome feedback from You, as We do all Our Customers. We try to ensure that Your experience is a positive one and to resolve any problems You might have with the Services. Should You have a complaint, or any other Feedback You can:
        1. find Our complaints handling procedure on the Website; andcontact Us using the contact details provided at the beginning of these T&Cs.

        1. We welcome honest reviews, and seek to ensure that You have cause to leave positive ones. If, however, You leave a review on Our Website, or any third-party review site, that is dishonest, untrue, exaggerated, fake or vindictive, We will take all such legal action possible to have them removed. We may also take legal action to recover compensation from You (including for defamation or libel) for any damage caused by You to Our business.

    1. Law and Jurisdiction and going to court
      1. This Agreement is governed by the laws of England and Wales.
      1. Wherever You live You can bring Claims against Us in the English courts. If You live in Wales, Scotland or Northern Ireland, You can also bring claims against Us in the courts of the country that You live in.

        1. We can bring a claim against You in the courts of the country that You live in.

    1. Transfer of the contract to others
      1. The Great Tythe Barn can transfer Our contract with You, so that a different organisation is responsible for supplying the Accommodation and related Services (for example if We sell Our business). We will tell You in writing if this happens and We’ll ensure that the transfer won’t affect Your rights under the contract.

        1. You may not transfer Your contract with Us to anyone else. You may not resell Your reservation and We will not honour any reservations if You do.

    1. Nobody else has any rights under this Agreement
        1. This Agreement is between You and Us. Nobody else can enforce it and neither You or We will need to ask anybody else to sign-off on ending or changing it.

    1. If we delay in enforcing this Agreement, we can still enforce it later
        1. We might not immediately chase You for not doing something (like paying) that You are required to, or for doing something You are not allowed to, but that doesn’t mean We can’t do it later.

    1. If a court invalidates some of this Agreement, the rest of it will still apply
        1. If a court or other authority decides that some of these T&Cs are unlawful, the rest will continue to apply.
